Terms and conditions applying to the use of the HOTmaths website ('the Site')

To become entitled to use the Site you must complete the application form ('the Application') below. If the Student nominated in the Application is 18 years of age when the Application is completed, the Student is to be the applicant. If, however, the Student is not 18 years of age when the Application is completed, then it must be completed by a parent, tutor, teacher, guardian or carer of the Student.

In completing the Application, the applicant agrees with HOTmaths Pty Limited ACN 094237233 ('HOTmaths') that the following terms and conditions will apply to the use of the Site by the Student.

1. In these terms, the word 'Subscriber' will mean the applicant, and the word 'Student' will mean the Student who is nominated in the Application. Where the applicant is the Student, the word 'Subscriber' will also mean the Student.

2. A separate Application must be completed for each Student who is to use the Site.

3. The Subscriber warrants that all information contained in the Application is true and promises to advise HOTmaths within seven (7) days of that information changing in any way.

4. The Subscriber will take, and will ensure that the Student takes, all reasonable steps to prevent the Student's password becoming known to any other person. The Subscriber will advise HOTmaths immediately if the Subscriber or the Student become aware of any unauthorised use of the password.

5. The Subscriber acknowledges that all programs, graphics and information of whatever nature located on the Site ('the Site Material') is the property of HOTmaths and is copyright −2006 HOTmaths. The Subscriber will not, and will ensure the Student will not, allow any other person to either use the Site or reproduce or otherwise transmit any of the Site Material in any way whatsoever.

6. The Subscriber acknowledges that although HOTmaths has taken all care in the design of the Site and the preparation of the Site Material, the Subscriber (in the Subscriber's own right and on behalf of the Student) acknowledges that HOTmaths will not on any basis be liable in damages or otherwise as the result of any error in the Site Material or in any other aspect of the Site.
   
   The Subscriber further acknowledges (in the Subscriber's own right and on behalf of the Student) that HOTmaths makes no representation as to the effect which the use of the Site will have upon the academic results which might in the future be achieved by the Student as a result of having used the Site.

7. If at any time the Student is referred through the Site to any other publication or information source, that referral will be made by HOTmaths in good faith. However, HOTmaths accepts no responsibility for any error in the information supplied by such other publications or sources.

8. HOTmaths will debit the credit card, particulars of which are given in the Application, with a subscription fee as identified in the Application. HOTmaths will take all care to ensure that the credit card details are not made available to any unauthorised person or entity, but takes no responsibility for any unauthorised use of those details.

9. The Subscriber acknowledges that HOTmaths will collect personal information on Subscribers and Students in the Application for the purposes of the operation of the Site and by completion of the Application authorises HOTmaths to do so.

10. HOTmaths may terminate this agreement immediately if at any time the Subscriber is in breach of the Subscriber's obligations (including as a result of some act or omission by the Student). The Subscriber acknowledges that termination for any reason will not entitle the Subscriber to a refund of any payments made to HOTmaths prior to the date of such termination.

11. Any notice given under this agreement must be in writing. Notices given to HOTmaths should be forwarded to contactus@hotmaths.com.au and Notices to be given to the Subscriber should be forwarded to the email address specified in the Application.

12. HOTmaths will refund Subscriber payments upon receipt of a written submission from the Subscriber that the site does not deliver that which it claims to provide. Refunds will not be given where the Subscriber is using systems other than those identified in the 'System requirements' or where the Subscriber is misusing the system.

13. It is the responsibility of the Subscriber to maintain the accuracy of any personal details, such as current email address, by going to the relevant link to update the details.

14. HOTmaths reserves the right to alter its product and pricing system at any time.

15. Except as permitted by the copyright law applicable to you or these Terms of Use, you may not reproduce or communicate any of the content on this website, including files downloadable from this website, without the written permission of the copyright owner.
